down2man (George Huang)

Just a quick update, I sent Dials28's the picture of my birth certificate and he let me know the one be bought from George did not match mine. So it would appear I'm now back to square one.

Did he sent a pic of his? Not accusing anybody of anything, but it would be nice with a picture to back it up - just to be 100% sure.

Yup! He was very kind in his response and understood how frustrated I must be.

His was a March 28th brithday.

Now all I can do is wait for George to responde here on the forums.

Hi Dylan,
I had recently been told about your post by a few of my friends, i feel this situation had gotten pretty bad and out of proportion so i feel it's time for me to finally tell my side of the story...
I purchased/paid for the Umnumzaan from you on the 9th-May, when i decided to buy it from you i deliberately chosen to pay you extra for the shipping as i said i wanted to choose USPS EMS shipping w/ tracking and INSURANCE, as it international shipping and i wanted piece of mind knowing that the package is going to be INSURED and TRACKABLE.

Been very anxious to receive the knife, i've been tracking it everyday, the last update i got from your tracking# was on the 17-May, and days-weeks later i had emailed you few times expressing my concerns that the status is not been updated, you were very certain in your response that you will contact USPS and let me know, and weeks after seening there's still no status updates and no knife in sight, i emailed you again, you said you were going down to USPS to sort this matter and filed for insurace cover. After days past i emailed you again asking how the process has progress, you told me to wait and this matter is been investigated. And a week or so later i emailed you again hoping to hear the outcome, you said claim denied. I emailed you i think 2-3 times afterwards and you didn't respond to any of my emails. After some more waiting hoping the package would show up or get a status update at least, but nothing showed. Been very worried i contacted Australia Post and australian customs and all i was told there's has been no package, nothing that came in for me. And since i also i wasn't getting anymore email response from you, with advice i opened a paypal dispute, and after almost a month of paypal's investigation they decided to rule in my favor because you could NOT provide proof of delivery.

And to this date, i have received NO KNIFE, NO PACKAGE, NOTHING from you. You are claiming customs seized the knife and it's all my responsibility, but i have not received any word nor documentation proofing the knife have been seized or ever even received by customs, all i can assume is it has been lost or stolen and since i paid for insurace, i think it would definitely be covered, why else would i buy insurance for.

I know this is a very unfortunite occurence for both of us, but me as a buyer i feel have done everything to right in this situation.

And as for the Umnumzaan that i sold on Australian Bladeforums to Dails28, it was NOT from you, he has the birth-card and knife to proof it's in fact a different knife, i think you already emailed him and got this confirmed. I had only sold 2 Umnumzaans in the past, one was sold to Dails28 and another was a tanto version that i sold to another member on ABF.

You have never emailed me nor notified me about your concerns or about this post, i feel if you have any concerns/problems you should definitely email me first before harassing other members on another forum (ABF), as they have nothing to do with this situation. If you have a problem with how i dealt with this situation feel free to contact me, USPS and/or Paypal.

And lastly i think this is a unfortunitely occurance for both of us, me as a buyer i feel did everything right here, your views may differ, with everything said, if the knife do show up in the future which tracking will proof i will definitely send you the money back but so far still no knife or papers.

George

Did you tell Dylan that you would accept full responsibility for the Umnumzaan once it left his hands?

claiming customs seized the knife and it's all my responsibility, but i have not received any word nor documentation proofing the knife have been seized or ever even received by customs

Yet the tracking info shows very clearly that the package was received by customs and has not progressed from customs, it would be logical to assume it is in the possession of customs.

I received nothing on my side apart from this tracking# dylan gave me, all i can assume is it's lost/stolen.

Have you looked at the tracking data he gave you mate ? I have and it clearly shows the knife as being in the possession of Australian Customs. As you are not a novice at this you must also be aware that the chances are that you will receive a notice of seizure in realation to the knife or, if you have previously had one or more knives seized, maybe even an in person visit from said service. I can't see how you are holding the shipper responsible for this as the issues with folders and Aus Customs are well and truly known to all of us in Aus. Why not a call to Customs to see if they have your knife and what is happening ? If they have seized it I would suggest that the seller has NO RESPONSIBILITY for that AT ALL.

Yes you did, you received a tracking no. which I'm sure you know how to use. Not stolen, not lost, in the possession if customs.

No i did not agree to that, why would i buy and pay for EMS w/ tracking and insurance cover if i did.

Would you like to check our email conversation? I would be more than happy to screen shot the email in which you agree to take full responsibly for any shipping problems.

At this point, that should be a given.

Back on May 9th, you contacted me about purchasing my Umnumzaan.

This was the first email we ever had.

"I have never mailed to Australia before. Does the USPS mail to Australia? Depending on shipping cost you might need to pay a little more.

Also once it is mailed it's all in the shipping companies hands since I've never shipped internationally before."

You replied too this email with:"Yes, I'll take it please! Yep, USPS does ship to Australia ofcourse, I've bought Umnumzaan and many other knives before from
the states, no problem."

Fast forward too middle of May and when I reminded you about you taking responsibility for the package you had no problem with it, you just expressed that you were a little concerned still.

This was the last email I sent you on June 7th. You never replied.

June 14th, you filed a dispute with paypal.

I will post a full transcript of every email we had between May 9th and June 7th tomorrow. When I get time to screen shot and upload everything.

Also,
I received nothing on my side apart from this tracking# dylan gave me, all i can assume is it's lost/stolen.

What more is it you were expecting?
You asked for insurance and tracking. Both of which I provided.

George.....

Honestly, if the buyer agrees that once the knife leaves the seller's hands they are not held responsible for anything that happens to the knife.... it means just that. You can't entice the seller to sell you the knife by agreeing to this and then not uphold your end of the bargain when things go wrong.

You KNEW there would be a chance this would happen. It was not the seller's fault that customs seized/detained the knife.

What you did was LOW, and you pretty much screwed a lot of good honest international buyers over on top of Dylan because now people like me will no longer sell to international buyers in fear of getting screwed the same way. I doubt you would refund him the money back. Just know you pretty much stole money from him... plain and simple. Karma will come back to you some day if you don't make this right.

down2man, how can you say you have no idea where the knife is? the tracking info you have shows that it arrived in customs? The seller provided you with tracking and insurance just as you asked for, so what else could he do for you? Like was already said, the insurance doesn't cover your purchasing of contraband that you know carries a risk of confiscation, so why should USPS pay an insurance claim for something that they delivered?

You know the rules, you took the chance, its your responsibility. Why do you think Dylan should be out the knife and the money when he did everything exactly as you asked of him? Now you are trying to play dumb and act innocent, which is clearly not the case. It is the buyers responsibility to know the laws of his country and you assume all the risk when try to import products that have a good chance of being confiscated.

x2

what a completely low down weasel move, and to act like you don't know whats going on with the package is just ridiculous, reading that pathetic attempt to "explain my side of the story" pisses me off, since they are basically the exact same story except you try to make it sound like the package was lost and its the sellers fault that the insurance won't cover it, and that you did the right thing. Oh, he didn't reply to your emails saying you didn't get the knife yet? That's because he already explained the situation, he talked to the USPS, he tried to get the insurance to cover it, it was denied and rightfully so. Dylan not replying to more of the same emails from you and telling you the same thing over and over again doesn't give you the right to steal this mans knife. I only hope that you will return the money to him or that you will get a well deserved perma-ban.

before harassing other members on another forum (ABF), as they have nothing to do with this situation. I
...they/we/I do have something to do with this as it is really a test of character and integrity. You can't expect to pull a stunt like this and NOT have it trash your reputation ??
