Those with unfilled orders need to request the PA AG to file an involuntary bankruptcy petition immediately to stop Guy from selling off the assets. Selling assets only benefits Guy and Ellie- and maybe HST if he has or had an ownership interest and assumed liability for debt, not those with unfilled orders.
I received my refund several years ago after very firmly staying after them. So I do not have standing. Side note - Ellie finally told me she would send a refund, but if I went through insisting on it she would never allow me to order again. I told her to send the money.
An involuntary bankruptcy filing happens whether Guy agrees or not, he has no say in it. The court will appoint a trustee to take control and liquidate the business in an orderly fashion and distribute funds to all creditors.
A bankruptcy trustee has the power to pull back funds Guy has sent to others. How far back in time the “claw back” can reach will depend on when they hit functional insolvency and whether fraud is involved.
Based on HST’s comment about Guy going backpacking in Asia, there is reason to think there is risk he will pocket proceeds from selling equipment and inventory and then goes on his “backpacking trip.”
Throw a net on that place before the assets vanish.
