What does that have to do with this thread?:confused: Most of the posts in here are from people with no dog in this fight, including me and including you... The fact is regardless of the stories Amherst has had problems with this in the past, that much is fact. Just work on correcting the problem and move on, everything else is drama which obviously isnt needed. I'm not trying to be cute here but you take somebody's money you damn sure follow up on the service if ya cant then communication is absolutely necessary, end of discussion.
Roland has just as much right to state his opinion as you or i do, regardless of where the hell he comes from:mad:

Roland's being located in Canada is irrelevant though I don't think that we need any amateur attempts at psychiatric diagnoses here on the forum.

I prefer to excise most of the fat and b.s. and look at the matter directly and simply:

A person offered products and services for sale. If they weren't available at the time of their being posted they shouldn't have been posted on these forums. Period.

Receiving money for goods and services offered without fulfillment is dishonest at best and possibly criminal.

I'm used to hearing long lists of excuses coming from my previous background in law enforcement so it's easier in this manner to just cut to the chase. All the rest is just noise imho.

Let's please try to stay on topic here. Allegations as to personality disorders or regarding the country of origin of the knives do us no good without proper facts, basis or documentation. I've heard the same rumors as everyone else. Fact is, regardless of what we may think or believe, absent evidence it's just gossip.

If you don't have confidence in the man, the product or the story my advice is to keep well back and prevent any potential issues from arising in the future.
 
Except for Bandaidman's post, I found Pappy's explanations entirely reasonable. However, 57 cases as defendant does strike me as highly irregular as does the case against Buck being dismissed w/ prejudice just 3 days after the court said that the case would be dismissed w/o prejudice if plaintiff fails to move for summary judgement. The only conclusion that I can reach is that there is much more to the story than has been shared here.

Regardless, I hope that Pappy gets it straightened out as the knives look great.
 
This whole saga still sounds bizarre to my simple ears.

The shear number of court cases really makes me wonder.

Tim, if you are indeed on the up and up, then I wish you all the best and hope you have much success with knifemaking.:thumbup:

As for me, I will return to my spot on the sidelines and patiently wait this one out.
 
i bought one of Pappy's knives in his first post here. i received it promptly, mailed to my USA address. it doesn't compare favourably with other custom folders that i have, but reminded me of my Rough Rider knives. my eldest daughter liked it, so i gave it to her.

well this guy's business dealings and lies to customers are well documented again and again in numerous BF threads.
this is not normal. this is not "right". something is wrong. the ongoing litany of excuses can surely no longer be believed.
my post as to what might be wrong, might allow others to realize that things are very unlikely to change, and thereby save them potential grief.
one of the things i like best about BF, is that posters can come clean with what they think, as long as they do not represent it as fact.

I (and by now I should think many or most) members of the forums are aware of the large number of issues which have been reported on the seller and the knives.

Sticking to the facts and avoiding much of the conjecture not only keeps the issues from being muddied but also makes it easier for those who are unaware of the prior history to glean the circumstances more directly.

I have my own opinions on the matter but just as I would try to protect you from those who might cast doubt on your character or personality on the forums, I feel an obligation to do the same for others as well.

It is better to come across as having some (attempt at) objectivity as opposed to appearing to have a questionable motive in our posts.

In any case, let's try to leave the conjecture and speculation for each person to mull over themselves and stick to what we know. The facts speak pretty plainly for those with their eyes and ears open.

'Nuff said imho.
 
I have made the necessary arrangements with Victor, Mike and Ren.

Their willingness to let me make things right certainly is appreciated and demonstrates their good character.

You don't seem to have a problem when it comes to offering your opinions (solicited or not) so please do not attempt to become the arbiter (after the fact).

I'm happy to hear that arrangements have been made with those who have had problems. Though I think it's a bit late in the game to say that it is only their opinions that matter at this point.

Quick Facts:

Buck purchased stag from Banyan Bay in 2005 and 2006. Ancient history.

We relocated our company from San Diego to North Idaho in Feb 2005. The downtime and the moving and start up expenses came in higher then plan and really reduced our free cash flow.

We worked out payment schedules with many understanding vendor partners. Banyan filed what I saw as a "pressure tactic" lawsuit which only served to delay his payment schedule that was already in place. All invoices were paid in full and the suit dismissed.

In Dec. 2006 he was stuck with inventory that someone else did not take so we bought it from him at a discount and paid very fast as a favor. Have not dealt with him since.

End of rant.

I'm sorry to hear of your troubles and wish you nothing but the best. I'm also sorry you had to suffer some of those "slings and arrows" via e-mail and post.:( But I'm very glad you're taking care of folks like Ren.

Richard, Roland is more than qualified to speak about medical issues. You don't have any more knowledge of what's going on than the rest of us in the peanut gallery.

It doesn't matter what the reasons are, there are no excuses I will use to avoid owning up to anything I do. Don't feel sorry for me! Hold me to a high standard! I won't run away and hide. Cowards run and hide. I won't make excuses, criminals make excuses. I will not do either of those things.

As a guy who is a bit nuts myself, these words mean a lot to me, fwiw. My apologies for any part I played in the pot stirring.
 
i am concerned about repeated complaints about non-delivery. it sounds like things have been rough for mr balda. i hope things improve for him and all these issues are resolved.

the court case referenced in pappy1959 post shows the plaintiff's case (banyan bay) was dismissed with prejudice. what actually happened here?

type in banyan bay into the lorain county court records shows 42 lawsuits involving banyan bay inc and another company named BANYAN BAY GENERAL CONTRACTORS with timothy balda often listed as a co-defendant. in fact 40 of the 42 cases lists banyan bay as a defendant.

type in timothy balda and you get 63 records. 59/63 have timothy balda as the defendant. a case from 3/10/09 (09CJ036585) shows a judgement of $70,000+ against timothy balda.

do all these cases involve you pappy1959?

Wow, there is one for $182,000 from 2008. Looks like Tim has not been too successful in the business world!!!
