"I'm used to hearing long lists of excuses coming from my previous background in law enforcement so it's easier in this manner to just cut to the chase. All the rest is just noise imho."

I agree heartily.

The tale of woe from a con man is as old as man himself. It's noise to distract you from his hand in your pocket.

To "cut to the chase" we all suffer losses in life and business, it's called the human condition...we don't cheat our customers...that's called evil.

Brownshoe, very refreshing to see your post tell it like it is. our backgrounds, and therefore, 'approach' are different, but the conclusion is the same, just expressed differently.

Last night Tim sent me an email with the packing list and the USPS tracking numbers.
I am sure he is really trying to make things good and straight.
Otherwise, he would just ignore this thread or any claim.

Pappy

I have a few things to say here.
-I am sorry for the loss of your son.
-I understand how that can change your life and your perspective on life. Has that happened to me, yes; twice. Did I feel like bashing my head through a wall, yes. Did I drink myself to oblivion, yes. Did I retreat into my own world when I was alone, yes. I could keep going on, but I think you get the idea.
-The one thing that this did not effect, was my integrity.
-When I went to work, I worked.
-When I sold knives, I mailed them.
-When people called me, I talked to them.
-Did I lie, yes. I told people I was doing fine, thanks for asking. People would ask me if I had any kids, I would say no, so I did not have to talk about it. That was the type of things I lied about. I never lied with malicious intent(or procrastination).

Pappy, you have one thing going for you. You love your job, or at least I am assuming you do. I do not know any other reason why someone would get into making knives if they did not love it. It is not a career to make a quick buck.

Me, I hate my job. It is not even close to the career I wanted for myself. Every day is filled with loathing agony when I work. Making your knives should be your release.

I think you have some soul searching to do and you have to come clean. Not just with your customers, but with yourself.

Wow, well put biggerjon!

Tim, I hope that you can find some people to work with you that can take some of that load off your shoulders and bring fun back into your business.

Tim,
Hang in there, you know that there are more important things in life, family and health amongst the first. Thanks for talking with me yesterday, I am praying for you and your family.

After your last post I was reminded of a verse, JT version, He without sin, cast the first stone, and then they all left as there were none.

Per Mr. Balda's statement:

"For the other self-righteous, arrogant and judgemental asses here who have so kindly offered their uninformed opinions even though they have no dog in this fight, they add nothing and help no one."

We are trying to help our misguided bretheren who are falling into your tale of woe just like those who watch Oprah. Your misfortune is no excue for cheating your customers. Your behaviour is classic con-job. You also keep yourself legal when it comes to felonies, that's why your civil court history is so telling. For those who wish to believe you, below are some facts from a previous post that have been avoided by you:

"type in banyan bay into the lorain county court records shows 42 lawsuits involving banyan bay inc and another company named BANYAN BAY GENERAL CONTRACTORS with timothy balda often listed as a co-defendant. in fact 40 of the 42 cases lists banyan bay as a defendant.

type in timothy balda and you get 63 records. 59/63 have timothy balda as the defendant. a case from 3/10/09 (09CJ036585) shows a judgement of $70,000+ against timothy balda.

do all these cases involve you pappy1959?"

In addition, you made some unfounded accusations about the Buck family. I was astounded given their 60 year reputation in this business. Mr. Buck's succinct response shows that they treated you more than fairly, but you sullied their name in this thread after they helped you out.

From CJ Buck "Quick Facts: Buck purchased stag from Banyan Bay in 2005 and 2006. Ancient history. We relocated our company from San Diego to North Idaho in Feb 2005. The downtime and the moving and start up expenses came in higher then plan and really reduced our free cash flow.
We worked out payment schedules with many understanding vendor partners. Banyan filed what I saw as a "pressure tactic" lawsuit which only served to delay his payment schedule that was already in place. All invoices were paid in full and the suit dismissed. In Dec. 2006 he was stuck with inventory that someone else did not take so we bought it from him at a discount and paid very fast as a favor. Have not dealt with him since."

I recommend you take Buck's path. Beware of Pappy...you don't want to be the 64th person in line waiting for your piece of his banckruptcy.

For the other self-righteous, arrogant and judgemental asses here who have so kindly offered their uninformed opinions even though they have no dog in this fight, they add nothing and help no one. They see themselves as being some kind of arbiters or judges of people when, in fact, they should not be throwing any stones. (( ... religious stuff ... )) The rest of you just like feeling important and listening to your selves talk. You all love to jump on the bandwagon when something goes wrong. No one talks about the hundreds of transactions I have done with knives that went right. No one talks about the tens of thousands of transactions I did with handle material that I did right. Jon's comments were what is considered constructive criticism. The critical comments made by others were just inflammatory and self-righteous.

Not nice. Not appropriate. Not responsive.

When some of our own get hit, we hurt. We speak up. That's what this forum is for. Not everyone who spoke up was dogpiling. Many were backing their friends in asking why it took till this thread was posted for you to communicate with people who had A LOT of money invested in knives you hadn't provided them.

We didn't need excuses OR explanations. We only wanted our friends to hear that refunds or knives are actually on the way.

Tim, I have not disclosed in this thread or any other your personal comments (good or bad) to me and they have no bearing on my remarks in this thread.

The fact of the matter is that I came to your defense in regard to a couple of remarks that were posted inappropriately in this thread, period.

Nothing you have ever said to me personally either publicly or privately has anything to do with my opinions on how you handle your business nor the questions which have been raised about the business, the knives and how you conduct business here on the forums.

This thread was about your failure to hold up your end on transactions involving members of this community. Period.

All the rest is a smoke screen to divert attention from the issues.

I hope you do make good on making restitution or supplying the knives or material to those that have paid. But the fact remains that the items never should have been offered here in the first place if they weren't ready and available.

By so doing you have abused the trust of this community and especially those with money at stake.

As a moderator and original member of this site I don't take that lightly.

My issues with you (which have been discussed via PM and email in private) were solely about your inappropriate use of the Traditional Forum for commercial posts. End of story.

Read into my comments what you may but you will not make this about anyone else but your own failure to honor your commitments to our members.

I am sorry for the loss of your son. How could I not be? But that tragedy is irrelevant to the facts presented in this thread.

So, once these problems are fixed, you will not see me on the forums any more. I cannot allow a small number of people, that I don't even know, have this much influence over what happens to my business or my family. I don't know what will happen to Amherst Cutlery.

I do not know what the future will bring. I'm going to take care of my family, take care of my health and take care of my friends. Anything else really is of no concern to me any more...

Take heart and have fun on the forums.

I will say no more. No one has any more right to any more information about my personal life. Sorry you had to know what you now do.

Good luck to all.

Keep Care,

Tim

Your words speak volumes as well, Tim...

...But regardless of how many times you have erased your threads and stormed off the forums vowing never to return, return you do. And regardless of how many times you've apologized for past failures to get your knives into the hands of those who have paid and waited for the promised goods (and have vowed to never repeat the transgression), repeat it you do.

Your record speaks for itself. I don't need to embellish it with innuendo.

I am currently waiting for a refund to clear as soon as it does I will let you all know and as far as I am concerned the matter wil be closed.

Hoping to pass on the good news soon.

Mike
