Geez, what a bummer. I can't imagine anything worse than only having half a knife...

Autos are a demanding mistress, especially if you live overseas. Maybe you should consider going with something a little less exotic?

My advice is, arrange all those bits of your Scarab artfully in a display, and hang it on the wall as a reminder to yourself.

You have learned a great and valuable lesson that will stand you in good stead in the coming years of knife collecting.

You might want to include, with your letter, exactly what the item was now that it appears you've been screwed.

Agree with PorcupineMtn66, nothing to lose if PP side with him over the order being delivered.

Show them exactly what you got screwed over on TWICE !.
 
20/20 hindsight is always loads of use :rolleyes: but, I would have probably filed a non receival dispute and counted that for the first knife you didn't get.
I know it was out of time for that one but you would have had more luck with PP for that than just a "not as described" claim I think.

I got a reply from my friend and he is actually away on business untill Tuesday but he said he knows for sure he only
has the handles for a Scarab. He may have some other pieces but will have to check when he gets home to be 100%.

The important thing here is, how you decided to have the knives shipped? Was it insured service (if yes, go to part marked with *)? If not, was that your choice (then it is basically your own fault if it got lost) or single-sided decision of the seller (if yes, go to part marked with *)?


* This is not something to let go. If you paid for the knife (on condition you also chose a INSURED shipping), you have legal right to obtain the goods or to get your money back (minus the provably expended sellers' costs (which may be e.g. phone costs related to your order (meant for calling you, not his suppliers), costs of shipping materials (boxes, bags) etc., which may account for a dollar or two...)

So you should contact your bank (the bank that issued your debit card) and let them know the situation.

There is a period of time to fill a claim for a purchases with your bank (in my case, it is 2 months from the date of transaction directly with the bank, and 6 months from the date of transaction for purchase transaction with the card issuer association).


My advice is to print your all e-mail conversations with the seller (including your previous purchase), take it with you and have a talk with someone at your bank. Explain your situation (you paid for the knives, and only received a half of a one, with seller uncooperating and not providing proofs of shipping) and demand to fill a written claim on BOTH these transactions (in one or two seperate claims, it doesn't really matter :)).

This might very well be considered a fraud (i.e. a crime)!

The seller recommended this and said it's safe to use this service that is low profile(very simple bubble bag) he has already sent hundreds knives this way, all successful. I agreed the shipping method, but after the first Scarab lost, I asked if he can use this low profile parcel and also with a tracking number. He told me he can use EMS but it will be investigated by Dutch Customs. So I agreed he took apart the knife and sent them in two packages in the former way.
When I bought knife from other sellers, I took all the responsibilities if the knife lost in the way because I knew my knife was really shipped. But in this case, I don't even know if my knife was really shipped or he forgot to send it (one knife shipped in two packages on two different days). Especially the second time I even remind him to take picture as shipping proof and he agreed, I still didn't get any receipt or picture. If he could show me anything to prove the knife was shipped, I wouldn't write this thread.

Indeed, if he doesn't even have the proof of shipping, i.e. at the very least the post office receipt, it only supports the legitimity of your claim.
Nevertheless, contact your bank ASAP.

I'll follow your advice to contact my bank to see what they can do, and I will ask for help in a legal aid center.
The sller contacted me last Friday told me he would send me the parts by Monday, also take pictures and give me the tracking number, ask me to pay only the shipping costs. I'm not sure if he's pulling more money from me so I said I could pay the shipping costs as soon as I see the picture and get the tracking number (that means I will pay right after he sends it, because I'm afraid to lose more money). Don't hear from him by now.

if they give you an address, always look it up to see what the deal is. could be the middle of a field for all you know ;)

No, it is not some student but an actual business that does not do retail just mail order. They are "units" and not your standard retail strip mall.
Thats been PVK's address for years...........................
