Since you don't reply and that delays this dispute, according to Paypal's policy, I can escalate the dispute to a claim now. Though you didn't want Paypal involved to decide, I have no other choice for you.


I sent a message to the seller today, I will wait for one more day, if he still doesn't reply, I will escalate the dispute to a claim, maybe I won't get anything back, but I'm not going to lose more time. I want an end of this problem.
 
IMO you should get the $400 in your PP claim back for the first knife and just keep what you have.
It's pretty clear the guy is going to stall about and do what ever he can to just spite you here.

(I know a collector of MTs over here who I know has done a destrucion test on a Scarab.
I can't guarantee anything but I can ask him if he still has any of the bits for it. :):thumbup:)

Earlier on this page, the seller says he will win the paypal dispute because you admitted receiving the item and that you were disputing the description of the item. And yet he does acknowledge sending the item in two packages. Will the fact that you did not receive both packges go in your favor when this goes from dispute to claim? Or can you file a separate action under item not received as well?

Hi Joe, I can only file one dispute. Thank you for your advice, that's a good point! I also mentiond in Paypal resolution center that I didn't receive full item, the missing part made the $400 a waste. The seller said in the resolution center that the missing part is $20 value, is that true? I heard that Microtech doesn't sell spare parts.
 
I don't mean to discredit anyone, but isn't PVK known for sending illegal knives all over the world. I know they provide a service for many knife nuts, but how do you explain this to paypal.

PVK ships all over the world to folks who do not participate in BFC and are unaware of things like this.

Thats why these threads pop up over the years with no significant harm done to his business. He loses a bunch here and gains a bunch of new customers there. While I have enjoyed 100% success buying near 100 knives from Josh over the years I am well aware of the negative publicity.
I have not bought a knife from or thru Josh in a few years but there are several reasons why that have little to do with the world of knives.

I wish you luck Mingyu and if you need an OTF MT I have one I can ship out to you as soon as I find it. Just let me know and it's a gift from one knifeknut to another!!

I have escalate the dispute to claim. I don't know if Paypal will investigate the problem I have, what can I do if the Paypal doesn't do anything?

Why I opend the dispute: When I didn't receive the other half knife, you just let me wait for it. 40 days past and when there was only five days left under Paypal's protection, I needed to open a dispute to allow me more time under Paypal's protection. We both knew you could not send the other half knife to me in five days, so what I did was reasonable according to Paypal's policy.

Why I would not cancel the dispute: First of all, I didn't receive the whole item, why should I cancel the dispute before I receive the other half from you? (you said you had 10 years' experience dealing with Paypal, how could you not know the buyer can keep the dispute open until full item received? If you still don't know, please ask Paypal service or just any eBay seller) Second, just the dispute won't cause Paypal involved to investigate your account.Third, you kept conning me and threatening me to cancel the dispute, then I knew I could not trust your promise that you would send me the rest of the knife after I cancel the dispute.

I have already experienced your different treatments before I paid(quick reply and nice words) and after I paid(several days waiting for your one sentence reply).
So you think after I paid and you got my money on your hand, then I just became a former customer less important than your 100s of potential customers? Then I think now is the time I should say: Thank you for your reply since you are so busy, sincerely thanks.

I also think the top handle part won't be stoled by anyone, so I asked you for the receipt from post office, or pictures I reminded you to take as proof. You ignored my requests again and you failed to provide anything to prove you really sent the other half knife to me.

I gave you enough time and chances to send me the other half knife, but the truth is you did not chose to send it, not I would not accept it. After enough time, since you were just threatening and conning me to cancel the dispute and you would not send anything to me, I knew that I could not trust your promise. I didn't want to waste more time on you so I asked for refund.

I truly agree with your last sentence!!! I received half knife with blade from you, a person in Britain received the other half knife from you. Same knife, not long time between I and the British man bought from you. Those things combined indicate not only a different story, but also a "complete Scarab".

To conclude, I did my best to explain to you, if you still say you don't understand or ask me the same things, I have no idea then, it's already my best English level.
 
Sad to say mate, it looks like he isn't going to come good with a refund (what you are owed !).

Over the years, and early in this thread, I often defended Josh from his detractors. No more...
It sounds like one way or the other you will end up with a decent OTF, but its not looking like it will be one from Josh.

Man, I don't know where to begin. I've just read every post in this thread, start to finish. You have been beyond patient, I wish you the best possible outcome. The seller is obviously trying his hardest to rip you off and has insulted your intelligence and taken advantage of your good nature in the process. I feel for you, I pray you get a full refund and the seller loses his "business" from the well-earned reputation he'll surely receive from anyone who reads this thread.

Yes you are right "seller is trying to make arrangements to refund your money". Since I'm not so skilled with paypal disputes, I've found (on this thread by the way) that isn't recommended to cancel dispute because is unable to open it again. It is according paypal agreement. Seller used benefits of paypal and when he losed dispute (it is logical without prove of shipping) he just closed account. Closing his paypal account I understand as admit of he never shipped knife.
 
laurin, your problem is with Josh K and it has been discussed at length in another thread. Go back to that thread if you want to continue with this. Do not hijack this thread any further.
 
I got resolution from Paypal:

I'm sorry to say I won't receive refund or anything from the seller. I filed the dispute as item not complete and mentiond there should be two packages, but Paypal didn't consider that.
 
Damn, if I was working like I did before the economy, I'd get that knife for you. There's a bunch of good guys here and I can only hope that you get something from Josh, especially if he really does have 100+ of these just laying around.
 
Im sure Im not alone when I say Id gladly donate to the mingyu got screwed by knifezilla fundraiser.
