You know, it appears you've managed to do something I've seen few people do on Bladeforums in all the years I've been there. As far as I can see, no one has lost any money or knives in dealing with you that will provide negative feedback, but there are members there that aren't exactly interested in dealing with you a second time. I wish I had contacted the guys I contacted last week when we first began dealing, but I didn't. Both of them said the same thing about you: avoid him and I wish I hadn't dealt with the guy. Neither was out any money, but just like my dealing with you, there are always "issues." Bad postage, bad luck at customs, etc. You post there under two screen names (guys figure this out when a payapl address is the same), and your emails come from Igor and Leo, and your American contact is in NJ. Could you possibly make it more suspicious? Your reputation is growing on that forum, and it ain't pretty.

Well, now I kinda regret paypal'ing him that $50.. Haven't received my aligner back yet and he said he shipped it on November 16th... Kinda fishy.

Yeah, that does suck and it will suck even more if you dont get your stuff. But unlike some people, you did the right thing :thumbup:

Can you do a paypal dispute or did you gift it? I sure hope you sent it normal and can get your funds back but when dealing with him I doubt you did. :(

Well, I emailed him and he said he'd check the shipment receipt... In terms of shipping, I haven't had a problem with him. I did do it as a gift though per his request. It might have just taken a while because of the Thanksgiving weekend.

if there is proof of a "double standard" actually being applied, kindly directly me to it.

I feel strongly that the Mods are fair and treat all the same.

Since two members have questioned my remark about double standards, let me elaborate: if nirvanero had done to an established member of this forum what Benya did to him (and others), he would have been banned within days.
Look at how people reacted about the DMT aligner mess, nobody sided with Heiheit, even though it now appears he was ripped off by Benya, too. I think moderators too often tend to go with the flow, so that when a lot of gold members & members with a high post count pile on a newbie the mods follow suit with sanctions.
Several people in this thread and its twin have complained about bad dealings with Benya and not a single mod has jumped in yet. I find this very disturbing, to be honest.
 
It's fairly clear now nirvanero isn't going to get anything back from benya.
He wound up paying near 400 for a used knife, that sold for about 190 NIB.
benya can say return the knife I sent you and get 300 back. Knowing that he can say it's not his when it arrives. Also knowing nirvanero won't want to pay more high dollar postage and won't want to lose the 95 dollars he's already spent. So, nirvanero is just going to have to write it off as a loss and move on it seems. What else can he do?
 
Heiheit could forward to PayPal the Pm or e-mail where Benya requests him to pay with a gift. Maybe if BF does not ban him PP will cancel his account.

I have read both the threads through and through. I agree with you Lorenzo. It's not only disturbing. It's a shame. I traded a couple times since I was screwed by t.degazio (and it was also very clear and did not lack evidence that he ripped off other people as well). Yet, he still has membership here. Though those trades after the degazio incident were ok this whole situation turns me off to trading online period. The reason being the lack of moderator involvement when the evidence is clear. I think I'll stick to the gun and knife shows from now on to do my trading.

I backed out of the other thread as I saw it not being productive but I have to remark on this comment. I have watched these threads unfold for quite awhile and I am basically stunned that nothing has been done by the mods on this forum. If something is going on or something has been done, although maybe it's none of our business, it would certainly be nice to see something said on the issue.

I try to stay away from the heat in a lot of these threads but this is just so lopsided I can't believe that justice has not been handed down in some fashion. I have never seen a clearer case (in my eyes)of someone being wronged as I believe nirvanero has been.

And like Lorenzol stated, if the shoe were on the other foot I think heads would have rolled. Sadly it is probably true that nirvanero will probably never be compensated for his loss, but, I think this forum is missing an opportunity to at least hand down some form of punishment in the form of a banning.

Saying nothing leaves the appearance of doing nothing.

That's all I got.

In this man's opinion a banning should be in order.

Since we have no clue what the Mods know or are doing behind the scenes it is unfair to claim a double standard is applied.

Please direct me to any other thread where an established member engaged in bannable conduct but did not get banned.

I will then agree with you, I just need proof and this thread is not it for me..........

I was posting here without emailing any mod, thinking "you read me if you want". After all this posting the FIRST time I wrote to a mod his answer was he was tired. When I said "why?" he replied "Yes, I'm tired. A lot has been going on. I have to draw a line somewhere". Nothing more nothing less.

I eventually get it. If you're a newbie no matter what you do because you're trouble if not everything is OK with rest of the members, even if that member means trouble for others. Would have been different if I had created a membership? We'll never know.

Now I know the evidence is clearly in Nirvanero's favor and I feel he was wronged, but no theft has occurred. The item's condition is what is in question, and let's face it, the mods aren't detectives. I doubt they will ban someone based on the evidence presented. Now had Nirvanero paid and not received the item, then their involvement would be a different story I presume.

Sadly, the only course of action is for Nirvanero to leave negative feedback stating that Benya "misrepresented" the items condition. This thread and his feedback will serve as a warning to future buyers. It's unfortunate, but that is the direction I see this going.

I know that I personally will never deal with Benya now.

when nirvanero's only option is to return the knife "in the condition" benya sent it for a refund, and the only person making the decision whether it is in that condition is the guy holding the money, that is blackmail, extortion, call it what you will. nirvanero sends that knife back i can guarantee that he will never see it or a dime of his money again. at the very least all benya has to say is that nirvanero sharpened the knife and no refund is in order. he can also easily hold onto the knife until nirvanero pays for return shipping. I'm not good at math but when all is said and done, nirvanero could potentially have spent over $600 for a used spyderco military.

Benya is virtually banned for some of you but I just hope if someone buying something from him steps into trouble won't hesitate to tell. It seems that some of the problems concerning Igor weren't posted before I had mine (not talking about negative feedback), and I think he had enough chances of being a honest guy for the whole forum instead of keeping lying everybody about his "NIB knife". After finding his "lost photos" he stopped lying as he didn't open his mouth again so he must be enjoying all that mountain of money... maybe he bought a Ferrari or an island, I don't know but it must be that good for ruining his reputation.
