Idiots on eBay - Classiccutleryusa

Here's the play-by-play of my Paypal complaint for anyone interested. Comes complete with threats for reporting "fraud" on my part, for being upset that I received a damaged, possibly used item in 10 days instead of 3-4 from Classic Cutlery USA :thumbdn:


From Buyer: Items For Sale on 3/19/2008 21:58 PDT
Seller took nearly a full buisness week to ship the item, after an instant Paypal payment was made on the same day the item was purchased. The item did not ship until I emailed the seller. The full shipping process took 10 days.The only reason I purchased from this seller was for the USPS Priority Mail shipping. I would have purchased from one of the cheaper sellers offering slower shipping had I known it would take 10 days to receive the item anyway.The item in question was a Spyderco Caly 3 pocket knife. It arrived with several scratches on both sides of the blade, existing scratches around the pivot point, some marring on the handle scales, and some scuffing on the liner of the knife. I understand that scratches around the pivot point may be a from the factory due to testing of the pivot at Spyderco, however the scratches on the blade appears to be signs of use.

All items we sell are factory-new, and unopened. We have tens of thousands of knives here in our warehouse, and we don't have time to open boxes, much less USE the items. This buyer has already tried once to extort the shipping fees by sending an e-mail demanding we reimburse shipping. We fill all orders in the exact sequence they are paid, and this buyer expects us to jump through hoops and place his order ahead of others. Buyer is mistaking TRANSIT time for PROCESSING time. The times posted BY EBAY (not by the sellers) are clearly described as TRANSIT times, and have absolutely no basis in reality. We have been shipping worldwide for more than twice as long as eBay has EXISTED, and we do know what we're doing, thank you. Buyer is just trying to scam a free knife. Our office manager will file a counter-claim with eBay and report this to our Top Seller Account Manager as fraud.

Buyer is exaggerating. Item was paid on 3/8 so order was not even logged until 3/9. Shipped 3/14 and rec'd by buyer on 3/17, all the way out on the Left Coast, so the TRANSIT time was within USPS expectations.

The seller having some difficulty understanding my concerns. The complaint being made is that processing time for my item took far longer than reasonable. The seller has asserted below that they ignore eBay's timetable for processing in lieu of their own. Additionally, as stated, the knife arrived damaged and showing signs of use, and is possibly a factory second. Aditionally, it is ironic that the seller has replied not once, but twice to this complaint. All of these problems could possibly have been avoided had the seller deigned to respond to any of the 3 emails he was sent over a 10-day period. Unfortunately, because of the seller's lack of communication, and now playing dense and ignoring any issue with the knife other than shipping, I have no choice but to escalate the claim.

I'm sure Dave the owner will be demanding you be arrested for sending death threats of some other BS.
 
DaveH, I really wouldn't be surprised. His strategy thus far has been reverse and exaggerate the complaints of his customer, and use them against the customer.

This is an example of the "Nuh-uh! YOUR momma!" methodology employed by top corporate defense lawyers around the nation.
 
He lists a Hopkinton, NH address and a Hudson, NH Phone number which is about 43 miles south.

That's a HUGE wharehouse.........................WOW!!!

Classic Cutlery U.S.A. just filed an unpaid item dispute against me, even though my Paypal account is less $106.00, and has been since the 8th.

I initially assumed he refunded the money, then filed the complaint. However, the transaction still appears in my Paypal account as:

Mar. 8, 2008 Payment To Classic Cutlery Completed Details -$106.64 USD $0.00 USD -$106.64 USD

Classic Cutlery is now guilty of attempting to defraud a buyer by collecting another $106.00, and filing a fraudulent claim with eBay. Unbelievable.

ID: #9DY115523F5052811. It was sent immediately after I purchased the item at Classic Cutlery's eBay
store.

The payment was also made with existing Paypal funds, and debited instantly from my Paypal
account. The email address paid was the email address provided by the seller in the auction. There
is no way it could not have cleared, as asserted by the seller.

This claim is fraudulent.
 
This Dave at Classic Cutlery is a real piece of work. If he keeps treating people the way he has been, he isn't going to be enjoying success much longer.

Would this not make him guilty of at least attempting mail/wire fraud???

This is just waaay too much. They shouldn't be in business. Will warn my friends not to buy from this seller. Will ask them to spread the word on their part as well. Buyers have rights.
 
I'm still waiting on an Emerson knife from him that I bought and paid for two weeks ago. All he said was that they sold out at a local gun show and mine would ship when they receive their next shipment from Emerson. No tmie frame or anything given.

I emailed him again and so far I have not received any other replies from him.

I might be filing with paypal soon as well.
 
Bimmer, whatever you decide to do, I encourage you to follow up with Classic Cutlery U.S.A. and make sure they don't get away with 'forgetting to ship' your knife, and post us an update when you have one.

This is one of the most unpleasant transactions I've had the displeasure of having to deal with in my history of online buying; and that includes a seller of Paintball marker accessories who kept $300.00 of my money for 3 weeks before refunding it to "teach me a lesson about patience," i.e. not email him to ask why he was selling items on his website as "in stock and ready to ship" that he was ordering from the manufacturer's online store, at additional cost to me!

I hope yours doesn't turn out the same way.
 
enderwiggin - The only reason Dave The Loser filed an unpaid Item Dispute was so that;

1. He could try and recover his Fees from Ebay when your Deal goes farther South.

2. Any Negative Feedback YOU leave for him re this Deal will not be included in his record (if he wins the Unpaid Item Dispute) - UNLESS you respond to the Item Dispute and keep it open. Keep responding to Ebay via the Dispute by sending copies of Emails, PayPal Transactions Links (showing you paid), etc. Also, report him to Ebay via the Safe Harbor / Report Items links (for selling Used Items as New).

Bimmer1 - I would suggest you file a report with ebay also since it is illegal to sell an item that is not In Stock! I would Cancel your Payment or demand a full refund immediately, then leave Negative Feedback AFTER you have gotten your money back.

This guy has to be shut down IMO.
 
I'll repeat myself, ebay etc aren't gonna do a damn thing. Contact the att gen, see eblow. Make it clear this guy is committing ongoing fraud.

I'd send a note to the local police to fuckheads, not that they care, but who knows they might get bored and pay him a visit.

Below is the email Classic Cutlery USA is refers to as “threatening” and used to “extort shipping fees with threats.” I have not altered it in any way, it is exactly as it was sent to the seller.

It's come to my attention that this item just shipped out today, even though it was ordered 7 days ago, and paid for immediately with Paypal. The fees were already in the Paypal account, so I know the money was cleared instantly. I guess I'm curious as to why the item took an entire week to ship, and only shipped after I emailed a reminder.

At the very least, I hope to receive a credit for the shipping. I would have purchased one of the other, cheaper auctions available with flat rate shipping if I had known shipping would take more than 10 days anyway.

I hope to receive a real reply to this message, as the last message was met only with an automated shipping notice.

As far as this part of the message:

From the Summary of My Selling Practices, posted by the seller in his own auction:

“Delivery We ship just about every day. If it's sunny and beautiful, we may close up the shop for the afternoon to explore yet another trail here in The White Mountains (yes, we actually use many of the great products we sell), but rest assured your order will receive priority treatment!”


This guy is clearly off his rocker, and I think I will go ahead and take DaveH's advice. Classic Cutlery U.S.A. needs to be reported to the authorities.

Square Trade's "Seal" is clearly a joke if they allow an individual who conducts buisness like this to continue to use their seal in auctions.
 
Interestingly enough, this thread still pops up on the first page of a google search for classicasshatcutleryusa!

It is because google search results are weighted.
Since BF gets a TON of traffic, any keywords that get 'spidered' out of BF get good exposure on Google.
 
That's good to know. Now anyone that encounters problems with these idiots can make reference to googling them in their ebay feedback...
 
I just filed a dispute claim with paypal for my transaction with Classic Cutlery USA. My second email to him has gone un-answered and I have $139.00 tied up in the transaction. I think it is absurd for someone to keep your money and not deliver the goods and not give you a definite time frame in which it will be delivered.
 
Good luck, don't let this issue die down. This selfish, lying and egotistic (as well as other traits such as scum) of a seller shouldn't be in business.
 
It took over a month and dozens of emails to get a knife from them.

It seems like every knife I get on ebay from an outfit with thousands of feedbacks takes forever.
